Can You Travel With CBD?
Now that CBD is legal in the U.S., many people are asking the same question: can you travel with CBD? The good news is, yes, you can travel with CBD. There are some caveats to keep in mind, though.
Under current laws, you can travel with any CBD products that are hemp-derived. It is still illegal to travel with CBD products that are derived from marijuana. That’s because marijuana-derived CBD contains THC, the active ingredient in cannabis products that give users a feeling of being “high.”
Because of this clear line of difference between the two types of CBD products, it helps to know what you can (and cannot) travel with — and why. Read on for what you need to know about taking your CBD with you when you travel.
Traveling With CBD Oil
Unlike with marijuana, you’re not going to get in trouble for traveling with hemp-derived CBD products in your bags. This comes down to key distinctions in legality.
Marijuana, as well as marijuana-derived products, are only legal in certain states. As such, you can’t travel with THC-containing products from a state where they’re legal to a state where they’re illegal. You can also not travel with them on federal airways since it’s states — and not the federal government — that have made them legal.
Alternatively, hemp-derived CBD products are federally legalized. That distinction means that you are free to travel with them across state lines and in federal airways. This is the same as you are allowed to ship them from state to state.
Flying With CBD
In late May 2018, following the passage of the updated Farm Bill, the Transportation Security Administration (TSA) changed its previously strict guidelines on traveling with any cannabis-related products to accommodate CBD. According to a statement on the TSA website:
“Products/medications that contain hemp-derived CBD or are approved by the FDA are legal as long as it is produced within the regulations defined by the law under the Agriculture Improvement Act 2018.”
This means that, when it comes to air travel, as long as your CBD products are hemp-derived and meet federal regulations, you are on the safe side. You are free to carry them with you in your carry-on bag or checked baggage.
Of course, there is a bit of a gray area here. It can be difficult for TSA agents to tell the difference between hemp-derived and marijuana-derived CBD products. Depending on who checks your bags, you may end up having to answer some questions. As a preventative measure, leave all of your hemp-derived CBD products in their original packaging so that you have some evidence on your side of their legality. Consider leaving yourself a bit of extra time at the airport, too, just in case.
